Terms of use
These Terms of Use apply to the Monetise U App at monetiseu.app and to the Monetise U hub page you install in your own Claude (together, the App), provided by Live It Up Lifestyle Pty Ltd (ABN 96 648 790 854) (we, us, our). They sit alongside the MonetiseU programme terms you accepted when you purchased the programme. Where the two deal with the same thing in relation to the App, these Terms apply. By setting up your account or using the App you agree to these Terms.
1. Your account
The App is for MonetiseU participants aged 18 or over. Your account, your password, your download stamp and the hub page you download are personal to you and may not be shared, lent or transferred. Keep your password safe and tell us if you think someone else has used your account. One account per person unless we have agreed otherwise in writing.
2. What the App does
The App gives you the weekly MonetiseU activities, the documents you build from them (for example your Master Brand Blueprint), and your AI team: Clarity Coach, Content Bestie and Email Bestie. The AI team runs on Claude, a service of Anthropic, through your own Claude account and plan, which you provide and pay for under Anthropic's terms. A paid Claude plan is needed for the AI team. We do not control Anthropic's availability, features, limits or pricing.
3. Your work and your chats
What you create in the App (your answers, documents, offers, content and emails) is yours. You give us permission to store and process it so the App works: so your chats and work show up across your devices, so your place in the programme is kept, so your AI team can draw on your work, and so we can help when you ask for support. Your chats with the AI team and your saved work are transmitted to and stored on our secure servers, as described in our Privacy Policy. You can delete any chat from your hub page at any time. Please do not put health, financial account or other sensitive personal information in a chat; if you choose to, you consent to us storing it as part of that chat for the same purposes.
4. Your licence to use the App
We give you a limited, personal, non-exclusive, non-transferable and revocable licence to use the App and its materials for your own business education during your MonetiseU programme and any extended access period stated on the sales page or notified to you. You must not: share, copy, publish, upload, sell or give away the hub page, the AI team's instructions or knowledge, the activities or any part of them; use them to run a programme, product or service for other people, or to build a competing tool; remove or alter the stamp, the licence notices or the App's checks; reverse-engineer, scrape or interfere with the App; or use the App or the AI team for anything unlawful, harmful or misleading. 5. Sharing, the stamp and what happens if the rules are broken
Every download of the hub page carries a stamp tied to your account, and every installed copy reports in through the Monetise U connector. One account appearing on an unusual number of devices, or a stamped copy turning up with someone else, is a breach of these Terms. We may suspend or cancel access to the App for a breach. Any refund is dealt with under the programme terms and the Australian Consumer Law.
6. The AI team is educational
The AI team gives coaching prompts and drafts to help you think and write. AI can be wrong, out of date or incomplete. Check anything important before you rely on it or publish it, and you are responsible for what you do with it. Nothing in the App is financial, legal, tax, accounting or other professional advice, and nothing promises income, sales or results. See the programme terms on results.
7. Availability and changes
We may update the App, add or change weeks and tools, and release new versions of the hub page, which installs itself the next time you open it. We take reasonable care to keep the App available but cannot promise it will be uninterrupted or error-free, and we are not responsible for outages or changes at Anthropic, Claude or other third parties.
8. Intellectual property
The App, the hub page, the AI team's instructions and knowledge, the activities, frameworks, templates and other MonetiseU materials, and the Monetise U and Emily Pivots names, belong to us or our licensors. Nothing in these Terms transfers them to you.
9. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded. Where the law allows our liability for a failure to be limited, it is limited to supplying the service again or paying the cost of having it supplied again.
10. Liability
To the maximum extent permitted by law, we are not liable for indirect, consequential or special loss arising from your use of the App or reliance on anything in it, including loss of profits, revenue, business opportunities, data or anticipated savings. You remain responsible for your own business decisions.
11. Suspension and ending
We may suspend or close an account that breaks these Terms, the programme terms or the law, or where the programme fee is not paid under the programme terms. You can stop using the App at any time and can ask us to close your account and delete your data by emailing contact@emswaff.com.
12. Privacy
Our Privacy Policy explains what personal information the App collects and how we handle it.
13. Changes to these Terms
We may update these Terms from time to time. We will tell you about material changes by email or in the App, and the date at the top shows the current version.
14. Governing law and contact
These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the jurisdiction of the courts and tribunals of New South Wales, subject to any rights you have under applicable consumer law.
